Mediating after Investigation: A Labour Relations Context

In this role-play, we meet two employees, Sancho and Mannie. Shortly after joining the Commercial Transportation Union (CTU) team in June 2019, Mannie seemed to have bonded with Sancho, the Senior Communications Officer and ten-year veteran of the CTU. Both Mannie and Sancho appeared to work well together and were frequently seen having lunch together or chatting away in Sid’s (their Manager’s) office. However, in October 2020, Mannie filed a harassment complaint against Sancho and her Manager, Sid.  The investigation was completed at the end of January 2021. The outcome was communicated to the parties. As part of the workplace restoration process, Mannie and Sancho have agreed to participate in mediation. Sid has also decided to participate in a mediated meeting with Mannie.

David E. Lewis is a Certified Mediator, Negotiator, Facilitator, and Human Rights advocate. He works with individuals and groups to identify, analyze, manage and resolve conflict using an interest-based model. He is a practicing labour relations consultant ( at both the federal and provincial levels), as well at the Founder, CEO, & Principal Mediator at Lewis Dispute Resolution Services (LDRS Inc.), a boutique ADR firm specializing in conflict resolution & training. David has over 10 years of combined experience in case management, conflict resolution, mediation, contract negotiation & administration, and leadership while working for organizations including the Public Service Alliance of Canada (PSAC-DCL Local 533), Ontario Public Service Employees Union (OPSEU-Local 562), Ontario Ministry of the Attorney General-Office of the Independent Police Review Director (OIPRD), Toronto Community Housing Corporation (TCHC) and the Canadian Union of Public Employees (CUPE Local 1281). His education includes two bachelor’s degrees focusing on policy, human rights & equity studies (YorkU), a post-graduate certificate in Alternative Dispute Resolution (Humber College) and a certificate in labour relations (Centennial College). He has also completed various courses in interest-based negotiation (University of Toronto) and business management (Rotman). He is currently pursuing a Bachelor of Laws (LL. B) through the University of London. David is passionate about social justice and enjoys volunteering within the community. He is a volunteer Community Mediator with St. Stephen’s Community House (Conflict Resolution and Training). He has also sat on the Education Committee of the Society of Ontario Adjudicators and Regulators (SOAR), and the Board of Directors of Pride Toronto. David’s varied knowledge, life experiences, and passion for helping others make him a well-rounded, out-of-the-box thinker and creative problem solver, who seeks opportunities to increase value and to make a positive social/human impact
